Beverly Biggs-Leavy, a candidate in the Third Ward recall election against the late Flint Councilman Quincy Murphy, on October 7, filed a lawsuit seeking a declaratory judgment and a related motion for a preliminary injunction in connection with the election.
The legal filings are in response to Genesee County Clerk Domonique Clemons’ public comments that Councilman Murphy could no longer be recalled and that Flint City Council will appoint a replacement for him instead of having the recall election occur as previously announced.

Regarding the legal filings, Ms. Biggs-Leavy said the following:
“I started my political journey to root out corruption and to help make sure Flint’s politicians are doing what’s best for their constituents instead of for each other or special interests. Mr. Clemons is attempting to unilaterally cancel a recall election despite, as my attorneys alleged in their court filings, neither Flint’s City Charter nor Michigan law allowing him to do so. Canceling the election would not be doing what’s best for the people of Flint, especially those living in the Third Ward. Mr. Clemons’ improper attempt to take an election out of the hands of Flint citizens must be stopped.”
