Attorneys handling the Flint Water Crisis criminal charges have stated that they intend to appeal the decision to drop charges against several key defendants. Earlier this month, Judge Elizabeth Kelly interpreted a ruling by the Michigan Supreme Court, that one judge grand juries, without a prior preliminary examination, cannot be used in felony cases. This meant that the case of Nick Lyon should be dismissed. The decision to dismiss the Lyons case directly impacted all of the defendants who have been charged criminally as a result of the Flint Water Crisis.
The team of attorneys, led by Detroit based attorney Kym Worthy announced on Tuesday October 26, 2022, that they still believe that they have options for trying the cases, and that they are planning to file a formal appeal.
The team said in a joint statement: “The residents of Flint have waited years for their day in court. The court proceedings up to this point have been a challenge to the process, not the merits of the case. The public deserves to hear the evidence against these defendants. Remanding these cases for preliminary exam is the next logical step in the legal process based on the ruling from the Michigan Supreme Court.”
