Feb. 11, 2025 (Flint, Mich.) – Beverly Biggs-Leavy, a resident of Flint, has filed a motion to intervene in a lawsuit currently before the 7th Judicial Circuit Court for Genesee County (Case No. 24-121982-AW, Judge Elizabeth A. Kelly) regarding the filling of the vacant Third Ward seat on the Flint City Council.
The motion alleges that Ms. Biggs-Leavy was twice elected to the Third Ward seat, first in the November 5, 2024, special election, and again at the February 5, 2025, Flint City Council meeting, but was illegally deprived of the seat on both occasions.
Specifically, the intervention complaint alleges that:
● Despite Ms. Biggs-Leavy being the unofficial victor of the November 5, 2024, Third
Ward Council election, election officials illegally refused to count the ballots and certify a
winner.
● The Flint City Council failed to fill the Third Ward seat despite its obligations under the
Flint City Charter and Council Rules, leading to the current lawsuit filed by the City of
Flint Ethics and Accountability Board.
● At the February 5, 2025, City Council meeting, Ms. Biggs-Leavy secured five of the
eight votes necessary to fill the Third Ward seat.
● After the City Clerk began announcing the vote tally, certain Council members engaged
in a secret caucus and attempted to change their votes, violating Flint City Council Rules.
“It is disheartening that the Flint City Council can neither honor the results of an election that our client fairly won, nor honor an agreement its members reached to elect our client to fill the vacant Third Ward Council seat,” said Jewuel M. Boswell, an attorney at Lento Law Group representing Ms. Biggs-Leavy.
Boswell added: “Each time, the people of the Third Ward are left to suffer. It’s time for Flint City Council to obey Michigan law, and for the City Clerk and City Attorney to hold them to it.”
The motion to intervene and related intervention complaint seeks a declaration from the court that Ms. Biggs-Leavy is the duly elected Third Ward Councilperson, and that she was elected by a vote of 5-3 at the February 5, 2025, City Council meeting.
