On August 19, Beverly Biggs-Leavy filed a lawsuit and motion for a preliminary injunction in federal court against the following defendants, alleging systemic irregularities and unlawful conduct during the August 5, 2025, general election:

In the court papers, Ms. Biggs-Leavy alleges violations of Michigan Election Law (MCL 168.764a and 168.765a), the Equal Protection Clause of the Fourteenth Amendment, and the Voting Rights Act of 1965, arising from unlawful absentee ballot handling, vote dilution and voter misinformation.
According to the court papers, absentee voters were falsely told that LaShawn Johnson was the only candidate in the election, despite Biggs-Leavy being a candidate on the ballot.
The court papers allege that this misinformation, coupled with unauthorized ballot collection and submission, materially distorted the electoral outcome. According to the court papers, although the Genesee County Board of Canvassers has already certified the election results and LaShawn Johnson was sworn into office within hours of certification, multiple state and local agencies are actively investigating credible allegations of election misconduct.

Larry Katz of the Lento Law Group, the attorneys representing Ms. Biggs-Leavy, stated:
Based on information we have obtained, there are serious concerns that LaShawn Johnson’s campaign resorted to unlawful tactics that resulted in her supposed victory. These concerns dilute the vote of each person and each candidate who followed the law. We are asking the federal court to require Michigan and Flint election officials to follow the law and prevent a council member from being seated despite their unlawful actions.
